Terms of Use

1. Nature of Service

TackleDrop is a communication and introduction service only. We connect independent lure makers (Sellers) with fishing enthusiasts (Buyers) to facilitate introductions and inquiries. TackleDrop does not sell, ship, authenticate, insure, or guarantee any item listed on this platform. All transactions occur directly between buyers and sellers, entirely off-platform, at the parties' own risk.

2. Prohibited Items

The following are strictly prohibited on TackleDrop:

  • Stolen goods or items obtained through illegal means
  • Counterfeit, replica, or misrepresented items
  • Illegal weapons, controlled substances, or regulated materials
  • Fraudulent documents or identification
  • Any item the seller does not legally own or have the right to sell
  • Any item that violates local, state, federal, or international law

Violation of these prohibitions may result in immediate account suspension, reporting to law enforcement, and civil or criminal liability for the offending user.

3. Seller Certification

By creating a listing on TackleDrop, the Seller certifies that: (a) the item is legally theirs to sell; (b) all representations about the item are accurate to the best of the Seller's knowledge; (c) the item is authentic and not counterfeit; and (d) the listing complies with all applicable laws. This certification is made under penalty of removal from the platform and potential legal action.

4. Platform Rights & Account Suspension

TackleDrop reserves the right to remove any listing and suspend or terminate any account at any time, for any reason, without prior notice or refund of any fees paid. This includes but is not limited to: suspected prohibited item listings, community guideline violations, fraudulent activity, or any behavior deemed harmful to the platform or its users.

5. Law Enforcement Cooperation

TackleDrop cooperates fully with law enforcement agencies and legal requests. Users agree to cooperate with any law enforcement investigations in which they are involved. TackleDrop will comply with lawful subpoenas, court orders, and government requests for user data without prior notice to affected users where legally permitted.

6. Indemnification

Sellers agree to indemnify, defend, and hold harmless TackleDrop, its officers, directors, employees, and agents from any and all claims, damages, losses, costs, and expenses (including attorney's fees) arising from or related to their listings, items sold, representations made, or any transactions conducted through the platform.

7. Buyer Responsibility

Buyers acknowledge full responsibility for verifying the authenticity, condition, provenance, and legality of any item before completing any off-platform transaction. TackleDrop makes no representations or warranties regarding any item listed. Buyers transact at their own risk and should exercise due diligence, including but not limited to requesting provenance documentation, independent authentication, and meeting in safe locations.

8. Dispute Resolution

TackleDrop does not mediate, arbitrate, or resolve disputes between buyers and sellers. Users transact entirely at their own risk. TackleDrop bears no liability for failed transactions, misrepresented items, non-delivery, or fraud between parties. Users are solely responsible for resolving any disputes directly with one another.

9. Violation Policy

TackleDrop operates a three-strike violation policy: three (3) confirmed violations of these Terms of Use will result in permanent account suspension with no option for reinstatement. A "confirmed violation" means a flag or report reviewed and upheld by TackleDrop staff. Severe violations (e.g., listing stolen goods) may result in immediate permanent suspension without warning.

10. Limitation of Liability

To the maximum extent permitted by law, TackleDrop shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. TackleDrop's total liability for any claim shall not exceed the fees you paid to TackleDrop in the twelve months preceding the claim.

11. Pricing & Plan Changes

TackleDrop reserves the right to modify, update, or discontinue any pricing plan, feature tier, or subscription rate at any time. We will provide users with at least 30 days written notice via email before any price increases take effect on existing active subscriptions. Continued use of the platform after the notice period constitutes acceptance of the updated pricing.

12. Founding Maker Guarantee

Makers who joined TackleDrop during the Founding Maker period (the first 25 approved makers) are entitled to a permanent 25% discount on the Maker Pro plan ($18.71/mo vs the standard $24.95/mo). This discount is locked in for life and will be applied automatically to their account.

TackleDrop will provide founding makers with at least 60 days written notice before any subscription billing begins.

13. Changes to Terms

TackleDrop may update these Terms at any time. Continued use of the platform constitutes acceptance of the updated Terms.
